According to the DMA 2004 E-Commerce Report:

* The portion of companies having an in-house email marketing list has increased from 74% to 85%

* 43% of Web and email investment is allocated towards marketing, compared to 35% in 2002

Giving ourselves permission to see the humor in our funny bodies and their functions eases the pressure we place on ourselves to perform sexually and our humor adds further fuel to our commitment to take ourselves less seriously.

Why wouldn't we laugh out of sincere appreciation for our perfect imperfections and the funny physicality of sex? To not see the gentle, and sometimes obvious, humor in these things means we are taking ourselves, and our sexuality, way too seriously. It's really all quite hilarious, in my opinion...we spend so much time, energy, and resources focusing on an act that takes less than 1% of our waking time. If we're not careful this teeny, tiny portion of our day can dominate our culture and our personal thoughts! Not that you don't have some good reasons to think about sex, but give yourself permission to gently laugh at your obsession and you'll find some additional stress released.

Step Three: Let Go Frequently

The last Fun Commandment we'll apply to women's sexual health today is: Let Go Frequently. I always say that in life, as in juggling, success depends on how quickly you are able to let go. Also in life, as in juggling, we all have a tendency to hang on to things too long, even when they are no longer working for us. In this case, hanging on to our harsh expectations creates stress that deflates our sexuality because we are unable to measure up.

Society deluges us with images of youthful sexuality; it's easy to imagine that everyone except us is engaged in passionate, daily sexual activity and we begin to feel that there is something wrong with us when our sex lives don't match the Madison Avenue fantasies. Let go of those images today, because no one except you has the authority or knowledge to decide what your optimal sexual habits and practices should be. Your sexual expectations regarding frequency, sensation, and/or duration are only placing unneeded pressure on yourself and that pressure only creates more stress.

Let go of your expectations of performance too. Many of my patients and clients imagine they must achieve a certain level of sexual performance for their mates to be pleased. Nothing could be further from the truth. When you set expectations regarding outcomes, you set yourself up for failure because you are putting even more pressure on yourself. Let go of the end results; concentrate on the fun, joy, and love inherent in sex because that is where the true pleasure is found.

Let go of sexual frequency and performance expectations, smile, laugh with yourself, and go along with whatever unfolds as a result of your footwork today. If you can do these things you will be a very sexual, passionate creature and sexy in the most important eyes of all - yours! Remember that you are already perfect (perfectly imperfect) and you don't need fixing. Have you ever thought about how your orientation to time profoundly affects the way you are in the world? Each culture has its own unique way of relating to the concept of "time". Some cultures perceive time as a room that is lived in. The "room" of time is a constant that stays the same, as we change during the course of our lives. American culture seems to more and more think of time as a commodity there is never enough of. When time is "wasted" a person misses out on an opportunity that may never present itself again. Still other cultures experience time as being circular, without a beginning or an end, and with no clear markers as to past, present, and future. No matter how we think about it, our relationship to time has a profound impact on what we believe is possible. Here is a story to illustrate what I mean.

Years ago I belonged to a healing community in the States. A women who was a member of the group had an infant who was born with a serious condition which was meant to limit the young child's life span to only three or four years maximum. The woman was totally committed to the health and well being of her infant, and she spent every waking moment praying for her baby. Her prayer went something like this: "Dear Lord, please heal my baby and help him to be fully healthy." She offered up this prayer countless times a day.

After some months of praying, and with the child's condition not improving, the mother spontaneously had an important "truth" present itself to her. She realized that in praying for her child to be healed, in a deeper sense she was acknowledging the "fact" that indeed her child was not well at this time. In effect she was saying/praying "Lord, my child is currently ill, and I am asking that you heal him and make him healthy in the future." She realized that if she was praying a similar prayer for herself, it would be difficult for her to feel good about her chances of being healed if she was continually reminding herself that she was currently not healthy. She realized that even though her child was way too young to understand the words of her prayer, that somehow her words would not be fully supporting her child in feeling and being healthy now as well as in the future. With her new understanding of how her concept of time was deeply affecting her prayer, she revised her concept and began praying the following: "Lord thank you for the health and well being of my child. I am eternally grateful." Rather than praying for how she wanted her child to be different in the future, she prayed "from the future" and brought her prayer into the present. She prayed from an understanding that her child was "already" healthy, and that he was simply in a rebalancing stage that if allowed to run its course, would naturally bring about a continuation of his healthy state as time went on.

After many months of praying her new prayer the condition of her child slowly began to change. The doctors were surprised and confounded. Little by little the child blossomed into full health, like a flower that is awakened to life by the warm inviting rays of spring sunlight. He eventually entered school along with all of his buddies, and wound up being a shining example of the power of love, gratitude, and an empowering understanding of time.

Please give yourself the gift of believing that you are already everything that you always wanted to be. Breathe into this radical concept, and then simply allow and encourage yourself to grow into your new sense of self.

With tons of information out there on "Fat Acceptance" does it do more harm than good? Being body positive and body fat are two different topics. South Beach Diet may work for one but not the other.

How can one confuse having a body positive attitude than with a "Fat Acceptance One? Are you really fat and happy? Most women are in emotional pain around their body size but to hail on for "Fat Acceptance" is a no-no, neither should one be ostracized for be overweight or fat.

This is more than just a debatable topic of "Fat Acceptance" what about health. Can you really sit and tell yourself you like wearing a size 22 and find the extra "Pinch an Inch" to be conformable and contrite? Can you feel both? Ask yourself, deep inside, how you really feel.

So where is the "happy medium"? Eye Candy yes, waif like magazine models perhaps not, but some women are naturally thin. Shows like "The Biggest Loser", "Fat Actress" make fun of those who do not fit into the cookie cuter world of what we deem as "Eye Candy".

We should all be accepted and not ostracized for size, and looks. "Size acceptance" and "Fat Acceptance" are two different issues here. Yes, promote size, we all come in different shapes, but promote "Fat"? What about health?

"We strongly condemn any diet marketing strategy based on guilt and unrealistic expectations," says Peggy Howell, a spokesperson for the National Association to Advance Fat Acceptance. "Such approaches cause untold suffering to fat people by ruining their self-esteem."

This would fall under stapling!?!

However some sites, and blogs take this too far, can you be happy, fat, and un-healthy at any size?

Why make this harder than it has to be, follow the BMI chart. However getting within our range can be difficult, while women and men, work their way from a high BMI to a lower healthy one, we should accept people of all sizes, "Size Acceptance" but not promote fat. Promote Health, Size and not Fat.

Finding a job can be a painful and difficult experience. Here are three things that you can do to minimize the pain and increase your chances of success.

How to find a job in 6 weeks!

1) Approach finding a job as if it were a full-time job, because it is. Consider this: if you had a job, you would report to work at the same time each day (like 8 am), take an hour (or less) for lunch, and quit at the same time each day (like 5 pm). You would work five days every week. And you would work hard to accomplish as much as you could because your career depended upon it.

When you are searching for a job, you should follow the same type of schedule because your future depends upon it.

Treating your job search like a part-time hobby guarantees that it will take longer. It even sets you up for failure.

In addition, the lack of focused activity will create a sense of helplessness. That sends you into a downward emotional spiral that makes it increasingly difficult to find a job.

So, begin tomorrow by reporting to work and spending the day on tasks that lead to a job.

2) Make it a project. That means you should set goals for yourself, make plans, and monitor your progress. You should apply all of the tools and skills that you used in your last job to the project of finding your next job.

As you must expect, this is an important project. The sooner you complete it, the sooner you gain a promotion into a job.

3) Be your own boss. You must set expectations for what you need to accomplish. You must provide direction. And you must monitor your work.

Meet with yourself once each week to evaluate your performance. I recommend doing this by writing two reports. The first is a candid evaluation of what you accomplished during the previous week. The second is a description of your plans for the coming week. Your plans should include your goals, actions, and priorities.

The first time that you write these reports, write an evaluation of what you have done so far. Describe the results that this effort has produced. And compare these results with what you wanted to have.

Next, map out a realistic plan for the next week based on achievable goals. For example, you could set goals for the number of people you will call, the number of networking meetings you will attend, and the research you will conduct.

In the coming weeks, compare the results that you obtained during the previous week with the goals that you set. For example, if you planned to attend twelve networking meetings and you attended only two, you should a) explain why this happened and b) plan actions that will correct such a difference. You should also analyze why you missed your goal because this provides insights on what you need to do differently. For example, your goal may have been set too high. Or maybe you could car pool with a friend who is also looking for a job.

Finding a job is a full time job. Work through it with a plan and the support of a good boss (yourself).

The ancient peoples of Europe were more fond of masks and religious ritual than you would suspect if you saw Europeans today. Mask wearing and shamanism was part and parcel of everyday life in ancient Western European tradition, say researchers.

There are stories abound about African and North American tribal shamans but not a lot is known about ancient European peoples' involvement with masked ritual or the practice of magic. That is why finding out about similarities between the ideas behind masks from around the world and those originating from European soil, is a discovery of intriguing and real beliefs.

societies with shamanism or religious ritual than for instance the North American native Indian customs or magic activity in the past is due to the more &sanitised' way Europe has developed because of church interference in people's lives. The church dominance virtually stamped out any pagan ritual.

It was not until after 1960, when the Americans experienced a revival of the interest in shamanism, that much has become known about the European version of the practice of magic and mask wearing. There is more verifyable information about the true roots of Western European civilisation than initially suspected.

"The spirit if not the exact practise of shamanism has been passed on through Europe's generations", one authority on the subject, Leigh Ann Hussey, believes. The earliest recordings of ceremonies involving masks were found in the caves of the Trois Freres (Three Brothers) in France where paintings of a Paleolithic scene depicting European animism of the first order. Ian Bracegirdle, a mask expert, describes the cave: A central figure stands wearing the head and antlers of a deer. He stands, shaman like, surrounded by animals.

The shaman, for that is what he seems to be, stands, a human figure amongst the potential food. It is believed that the paleolithic cave served as a place where hunters were initiated. He wore ears and horns of a stag, the eyes and beak of an owl, the bearded face of an old man, the tail of a wolf, the paws of a bear and the legs of a dancing shaman. He stood in front of painted hunting murals. The Shaman served as mediator between humans and their venerated animal kin.

This is pretty much the best evidence in tangible form that we have of our ancestors' animistic beliefs. It dates back 10,000 years and is accompanied by an abundance of myths and stories showing our ancestors had plenty of similar ideas. His information is confirmed by Ms Hussey, who went on a hunt in European shamanism and found when she examined ancient sources, that she did not need to borrow from other traditions. "It is clear that tribal Europe had as strong a shamanic tradition as, for example, any of the American Indian tribes," she said.

Summing up the general symbolism that unites masks from around the globe, Bracegirdle says that there are many striking similarities between the ancient cultures of the Pacific West Coast of North America and the tribal traditions of Africa. Symbols that all these cultures share are relating to fertility, the hunted animal, ancestors, initiation into rites, circumcision, cannibalism real and symbolic, healing and crossing over into the spirit world for guidance and healing powers or to appease the gods or ancestors are the accompanying ideas behind masks.

Not a lot has been passed on from generation to generation in any much recognisable form or shape, but among the most powerful links is the seasonal nature of many traditions we still know about. In the UK, the Green man and the Hobby horse are two potent examples. "To me there is a tremendous link which is bound up with the very nature of the people we are and how we have developed. Our formative roots live in our societies now", believes Bracegirdle.

The links to ancient beliefs can also be found in many European languages. When we say in English that we are going berserk, we even directly refer to the shamanic state of extasy. The adjective comes from the noun &berserker', or &berserk', the Old Norse for &wild warriors' or &champions'. &Ber' referring to &bear' and &serkr' to &shirt' or &coat'.

These berserkers became frenzied in battle, howling like animals, foaming at the mouth, and biting the edges of their iron shields as if they acted in a Nike commercial. Berserker is first recorded in English in the early 19th century, long after these wild warriors ceased to exist. This is illustrative of how the tradition seemingly interrupted, still lived on.

Similar "Bear Doctors" stories have been found among California tribes. In some cases, the Berserkr or Ulfserkr would even eat the heart of the bear or wolf to gain its power.

Not a lot was known about Western shamanism until it hit the limelight in the 1960 and the undoubted expert in the field is the late Mircea Eliade, a religion historian who taught at the Sorborme in Paris and later at the University of Chicago.

He described Shamanism, or &witchcraft' as it is referred to also, as not a religion but more as a technique. Shamanism, he says, is &not strictly medicine men/women, magicians, or healers'. This is the conclusion of extensive studies of the phenomenon around the world in his book &Shamanism: Archaic Techniques of Ecstasy'.

He believes that shamans are not the same as priests; they may have coexisted with priests or even have fulfilled priestly functions as well as shamanic ones. A shaman was more a mystic than a priest or a minister. A shaman was not "possessed", as many people now believe, says Eliade. Neither was the shaman a medium or trance channeler. "Shamans control the spirit beings with whom they work, or at least they do not surrender to them. Like a medium or channeler, a shaman may appear unconscious when working, but upon returning, the shaman can tell where he or she has gone", he says.

The shaman is not the instrument of the spirits. Traditional shamans cure people through their trances, accompany the souls of the dead to the Otherworld, and communicate with the gods. "This small mystical elite not only directs the community's religious life but, as it were, guards its 'soul."

Modern day processions where you can still see old masks being worn include processions in which giants and witches are displayed.

Witchcraft Exposed

These and other masquerades are among the more powerful tangible links we still have to ancient witchcraft ritual.

In well known childrens' stories and folklore narrative, the links are also obvious. Dragons for instance are examples creatures pervading every alley you can imagine of old folklore and mythology, straight into modern times stories. Descriptions of the beast's benevolence vary from the playful Puff (of Peter Yarrow's song) to the sinister Smaug in J.R.R. Tolkien's "The Hobbit". Babylonian legends portray the Queen of Darkness as a multi-headed dragon - Tiamat. Walt Disney's Sleeping Beauty features a battle between Prince Phillip and the evil Maleficent about a curse than can only be broken by three fairies. Likewise, the Germanic myth "Die Nibelungen" climaxes with the battle between Siegfried and the giant Fafnir, who has transformed himself into a dragon in an effort to become more frightening.

Our reaction to the physical characteristics of the dragon is another element that we share with and which connects us to our ancestors. Around the world the beasts are typically depicted as huge lizards, larger than elephants on average. Long fangs are generally accepted as are twin horns of varying length. Western cultures generally include large bat-like wings giving the dragon the capability of flight. But eastern dragons, usually wingless, use a more magical means of flying. Eastern dragons also tend to be more snake-like in nature, albeit with front and rear legs.

one technique of the Option's strategy of investing but can be a power tool in your investors toolbox to help you control more real estate and build wealth.

An option is an agreement to you from the seller that gives you the exclusive right to buy a property during a specified time and at a predetermined price but does not obligate you to make the purchase - This is why it's called the Option agreement.

You option to buy - You option not to buy.

Option investing works when you want to control more real estate with limited out of pocket cash or credit and works if you:

Have no credit!
Can't pay cash!
Can't get a loan!

I call this the "SWEAT OPTION".

The sweat option works well if you have the ability to do the repairs yourself.

I recommend that you farm out your market area looking for properties that are what we call in the industry FSBO's (For Sale by Owner).

Go to your local library and start your research by looking at old newspapers starting with newspapers that are 90 days old and work your way through the FSBO's section making a list of possible deals. Working on a list of 30 or so.

Call and see if the property is still on the market, if so make an appointment to see the property! You will find that none owner occupied properties work the best and you are looking for properties that can not compete well with other homes do to repairs that need to be done.

Let's say the seller has a property that is worth $100,000 after the repairs.

I like using a 5% rule for repairs - If the value of the property is $100,000 after repairs, I do not want to spend more than $5,000 or 5% in repairs.

I would negotiate say an option purchase price of $80,000 for a period of 6 months or more and in the option agreement to perform the repairs at my cost to be my consideration for the option of purchase or should I say the $5,000 in repairs, materials cost and labor to be considered as credit towards the purchase of the property (My down payment) and what ever monthly payment we agree to and credit amount of that monthly payment. So let's say we agree to pay $600 a month with $100 a month credit towards the purchase.

You start you're repairs and complete them in 30 days or less and let's say you purchased $1,500 in materials.

Now you place the property on the market because you have the option to purchase "You have taken control of the property with your option".

Let's say this deal has taken you 90 days from the beginning to the end.

You find your buyer let's say at a great deal of $95,000 - $5,000 below market value at this point you would simply exercise your right to the purchase option and do a simultaneous close.

Now let's run the numbers

Your option purchase was $80,000
Your option credit of $5,300 (Repairs, materials cost, labor & monthly credit)
Your purchase price after credits $74,700
Your buyer purchase price of $95,000

Leaving you a gross profit of $20,300

You had out of pocket material cost of $1,500
You had 3 payments of $600 each with $100 for the credit purchase with an out of pocket of $1,500

Carrying cost of $600, (Real estate taxes $300 &$300 Utilities)
Advertising cost $300
Closing cost $1,300

Your net profit $15,100

You simply took control of a $100,000 property for $3,900 (payments, materials, utilities, and advertising) and turned a profit of $15,100 in 90 days!

Look at it this way you can make it a cash purchase at $80,000 and take control of one property or be a little creative and take control of the same property for less than $4,000. Both conservative and creative deals work in the world of real estate investing.

The Sweet Smell of Success - Start Your Own Bath and Body and Perfume Business

It's amazing how important the sense of smell is to many people. If you're selling your home, and this applies across the board to houses, townhouses, condos, apartments, or whatever, you need to be aware of the power of odors. An odor like cigarette smoke can cause potential buyers to leave quickly without ever really considering purchasing your home. On the other hand, an odor like that of bread baking can conjure up all sorts of homey feelings and cause the same potential buyer to linger.

Do You Have "Deal Killer" Odors?

The two most common offenders are cigarettes and pet odors. Sadly, most people who smoke or have pets don't realize this. Often, they don't notice the smells themselves, so they think this isn't a problem. Well, it is. A surprising number of people will have a swift, strong, negative reaction. Would you like to smack every second or third prospective buyer in the face when they come through your door?

Anything cloyingly sweet like "room deodorizers" which really just cover up other scents by overwhelming them is likely to be an offender. The same thing is true of other strong, funky smells. Unwashed gym clothes and shoes, cooking smells from foods such as cabbage, fish or more than a little garlic or curry will probably be offensive to many people.

So is it really necessary to stop smoking (or only smoke outdoors), ban the dog to the garden and basement, wash the laundry, and stop cooking strong smelling foods until your home is sold?

Yes.

Beyond that, it's necessary to "clean up your act" if you're really desirous of selling your home. You've probably cleaned it up visually already, but what to do about lingering odors? Anything made of cloth holds odors for a long time. Carpets, upholstery, curtains and draperies, table skirts and the like will smell for months or forever. What on earth do you do about them?

If it's bad enough, carpets need to be replaced and upholstered furniture put into storage. However, it's often adequate to shampoo carpets and the upholstery in the most intense areas (your favorite smoking chair and the pieces nearby) and launder the curtains. Keep fans going while things are drying; you don't want to end up with mold and mildew smells. Your goal is to clean up the cause of the smell, not to cover it up.

Attractive Odors Attract

Odors people find attractive are very personal, but there are general smells that are pleasant and cause good emotional responses in most people. We've already mentioned baking bread. Almost anything that smells sweet when tends to be in this category - cookies, apple pie, cinnamon buns, etc. Of course, it's not practical to bake the whole time your house is on the market, but one thing each week-end might be possible.

In cool weather, apple cider simmering with a cinnamon stick or two and a few cloves has much the same effect and is definitely easier to do. A vase or two of flowers with mildly scented flowers is another possibility.

Of the two, cleaning out offending scents is much more important than adding pleasant ones.

Want to become an article-writing machine? Here are a few tricks for submitting articles on the internet at top speed and accuracy.

As always, you should first type your article text into a Word document and save it on your hard drive. Many article sites offer space on their servers for your work, but ideally you should have a home for it on your own computer- just in case. Next, transfer your article text from your Word file to the article submission box. The quickest way to do this is to "set it all up" ahead of time.

Quick Copy-and-Paste Article Transfer

Start by finding a music CD of your choice that will get you into some kind of groove. Pop that into your Discman, CD player or whatever else you like to listen to your tunes on, and settle down in front of the computer. Take a deep breath, sit up straight, palm the mouse and then do the following:

1. Log in to your Ezinearticles.com account (or whatever other account you may be using to submit articles.)

2. Go to your existing Author Bio and hit Control-A (Highlight All) and then Control-C (Copy).

3. Go back to the Word file where your article is located and scroll to the end of your article, after the copyright line. Type Control-V (Paste) and add your bio text.

4. Now type Control-A (Highlight All). The text of your entire article and bio will be highlighted. Type Control-C (Copy).

5. Return to your article submission box and do a Control-V (Paste). Both the article text and the Author Bio will now be housed in the place where your article lives.

6. Scroll down to the end of your article text; that's where the Author Bio is. You are going to remove it from here and pop it into the Author Bio box.

7. Highlight the Author Bio text with your mouse and then do a Control-X (simultaneous Delete and Copy).

8. Go into the Author Bio Box and Control-V (Paste). Your author bio should now land in the proper place.

Note: when writing articles for the internet, it's wise to break up your text into easy-to-read sections. Bolded subheadlines will guide the reader's eye down the page, thereby holding their attention on that excellent copy that you took such care in writing!

Here's a formula for adding bold, ital and other HTML tags to your articles in a hurry.

1. Type your entire article in regular type, with no code.

2. Go to the first sentence that you want bolded and type your < B > code (but without spaces).

3. Highlight the HTML Bold tag that you just typed, and hit Control-C (for Copy).

4. Now go to the end of the line where you want the Bold to stop and hit Control-V (for Paste). Now add a / mark before the B in that end tag.

5. Scan the article from top to bottom wherever you want bold, copying and pasting tags where necessary.

6. Go back to the top and repeat the process for Italic, if you have that in your article too.

Bonus Tip: To get your mouse to the beginning or end of a long page of text (such as an article), type Control-A (Highlight All), and then the Up or Down Arrow. If you accidentally delete it, just hit Control-Z (Undo) and it should appear again.

A quick copy-and-paste routine like the ones I just described really comes in handy when submitting articles in mass distribution. Faster is better! Have fun.

Building Your Wealth Consistently in Minutes a Day

Let's face it -- none of us like to be ignored. But sending an e-mail to a colleague that commits even ONE of these four cardinal sins can mean the difference between a speedy reply ... and that big e-mail receptacle bin in the sky. :-/

Here are four common reasons why YOUR mail could be going "the way of the spam", and how to reverse them to get your messages answered -- and answered *fast*:

1. "Can you hear me now? Durn! Can you hear me now? Frick! Can you hear me now? Cripes! Can you...?"

Follow-up e-mails are okay, and quite necessary during these times of overzealous spam filtering. But for the love of all things good and holy ... please give your recipient a reasonable amount of time to answer the FIRST message FIRST!

If you haven't waited *at least* 24 hours -- particularly on a first contact -- you haven't waited long enough. People do have to take care of lives, and spouses, and hunger pangs, and bathing, and... (well okay, maybe not those last two if we're in a REAL pinch ;)).

2. Please, God ... *NO* HTML!

It still boggles my mind how many people ignore this rule.

HTML mail comes to about *twice the size* of plain text mail with equal content. If your recipient can set their mail to skip downloading messages over a certain size, and that size is set low, your e-mail will be cut off in mid-message.

This means the recipient then has to make an extra effort to retrieve YOUR message from the server.

(Annoyance #1.)

And people who send HTML mail seem to always choose a bright blue(??!) hyperlink-colored font that's WAY too tiny for the average eye to read. Umm...

WHY?!

Just about anything other than Courier New is GUARANTEED to be hard to read in some e-mail programs -- and it's usually blind luck that your recipient will HAVE one of those with this problem.

(Annoyance #2.)

And don't even get me started on the odd "glow" blue text has when plopped on a white background ... please?

3. "NO, Mommy! I don't WANNA read an ezine!"

It's inconsiderate to send ezine length e-mails to business people -- period.

You're almost guaranteeing that your mail won't be fully read, or that you'll get a half-a**ed reply, because the reader didn't feel like wading through your verbosity to get to the goods.

"Ezine length" is generally about 9 kilobytes (9k) and above. You can usually tell how large an e-mail is before sending by checking its size in your mail program's outbox. If not, for your reference, 9k is about 650 words. (Yeesh!)

Unless the recipient is *expecting* a long reply from you, 3k (200 words) is a good stopping point for a first contact.

NOTE: YES, this goes for personal e-mails too. Being "friends" with someone isn't license to consistently disrespect their time with mammoth e-mails unless they send the same to you -- consistently.

So, no saying the same thing 8 killion different ways, or using "flowery" language and "pretty" mental pictures to get your point across.

Just say it, say something else and for Heaven's sake ... KEEP IT MOVING.

4. Umm, seriously ... is it really THAT important?

Ugh. Do I really need to explain this one? People who mark ALL of their messages High Priority remind me of the little dude who cried wolf, if you know what I mean.

When I consistently see these from the same people all the time, I start ignoring the priority and answering them LAST in a mail check, just to spite 'em.

Granted, not everyone is as crazy as me and will do this. But at the very least, you're still hurting your chances of getting a reply to *seriously* urgent messages quickly, by abusing priority markers.

I could go on. I won't.

I'll save the rest for "Part 2." Until then, clean up your e-mail act if you need to, and watch more of your e-mails not only get answered, but get answered faster -- and lots more productively, too.

Life in today's hectic society is going more and more in the direction of fast food restaurants, sugar in foods you would never think should be there, trans fatty acids, preservatives and pesticides which we consume in large amounts every year. You may allow yourself to be recreated in the image of someone else. The truth is you were already created in someone else's image, the image of God. Your task is to devote your life to making principles that authenticates your God-given self.

PARADIGM

Your paradigm or your pattern of doing things is a bye product of so many factors; such as your cultural and religious background.

The cultural practices and believes you know and sometimes participates in. your religious background - your faith, believe and your understanding of several religious practices will go a long way in determining your paradigm.

Your paradigm is one of the factors that determines your principles and must be based on believes that are well established in your faith. Must be based on your relationship with God and not on a religion.

Realistic living is all about taking time to understand your disposition- the natural qualities of your person, with a view at examining what it is that your life is centered around and afterwards creating principles that will guide you to a life you want bearing at the back of your mind the roles played by these three factors - purpose, people and paradigm.

Is your life based on correct principles that do not change, regardless of internal conditions, influences and circumstances? Are you guided by a compass, which enables you to see where you want to go and how you will get there? Does your judgment encompasses a broad spectrum of long-term consequences and reflects a wise balance and quiet assurance? Are you a self-aware, knowledgeable, proactive individual, largely unrestricted by the attitudes, behaviors and actions of others?

In Corrogue I feel wonderful.

As friends know I love singing. I am presently singing, "I've got a wonderful feeling everything's going my way." Actually this song sings me. If I were not writing I would be dancing and singing.

This is one of the great blessings of well being. It is the blessing of drinking from the well of being. In Ireland we love our wells. We are still deeply connected to the elemental relationship of water and wells. We intuitively know that wells and well being are connected. All over this enchanted land are thousands of wells that are still revered as places of healing.

These wells are still used. I see people on occasion, not far from this "place of the briars,"circumambulating the ancient well at Tuber. This is despite the fact that this well is empty. People come to this well to find well being for themselves and others. They often remain silent. It is a time of reflection and a time of humility. Often life seems out of control. Often their well of being has run dry.

Our being is our essence. It wishes to be the play of the world. It is a wonderful feeling. It is free flowing and Divine. You have to honour it. You have to return to the source. This is the source that is life and not simply "your life."

Being and well being is known in the silence of the heart. Much experience of non well being is emotionally and spiritually based. As Carl Jung the eminent Swiss psychologist remarked, "I have rarely met with a patient over the age of thirty five years whose problem is not one that is related to their spirituality."

Well being is a deep connection between our physical, emotional, mental and spiritual energies. We connect to these energies by listening. We connect by listening to that still inner voice of the heart. This is in order to hear the song you alone have come to sing. If you do not sing this song you will not feel at ease. You will enter dis-ease.

We are afraid of this inner voice. It may ask us to change. It might tell us things we know about ourselves that no one would ever want to know. It might remind us that once we had dreams. We might have dreamed of visiting other places, writing a book, learning to dance, take up a task that everyone else told us was irrational.

Your inner voice is irrational. It is the holy part of you. In that sense it is whole. The word "rational" comes from the word "ratio," meaning "part." Your inner voice is like the frog in the well. It sets on the edge of the well of being asking that it be taken home. It wants to be appreciated. It wants you to kiss it. When you appreciate it you transform it. It becomes the beauty it always was.

Authorise your own voice. Drink of the sound of your own song. You will raise your body's vibrational rate. You will become more refined and you will begin to feel fine. You will be singing "good vibrations." Maybe you to can go skipping down the lane singing "I've got a wonderful feeling everything's going my way." You get to play in the musical of your own life. You get to sing and dance the celebration you have come here to be.

Life is love. It is the ocean of love expressing moment to moment. This ocean of love is what we know as well being. Come to this well. Speak your truth and sing your song. Drink deeply of this well of love that is in essence who you are.

Screenwriting: How to Write a Screenplay that wakes up the world.

Creativity can be defined as problem identification and idea generation whilst innovation can be defined as idea selection, development and commercialisation.

There are other useful definitions in this field, for example, creativity can be defined as consisting of a number of ideas, a number of diverse ideas and a number of novel ideas.

There are distinct processes that enhance problem identification and idea generation and, similarly, distinct processes that enhance idea selection, development and commercialisation. Whilst there is no sure fire route to commercial success, these processes improve the probability that good ideas will be generated and selected and that investment in developing and commercialising those ideas will not be wasted.

Short term goal setting

The value of short-term goal setting on creative output should not be underestimated:

a) Short term goals break a task into smaller more manageable parts. What at first seems unfeasible becomes feasible when incremental goals are set. Feasibility is one of the requirements of motivation.

b) Short term goals produce far more output than a "do your best" approach. Write five pages a day and you have a screenplay in a month (first draft only). Do not implement that routing and it will remain unfinished under your bed until your kids grow up. Maybe they can take over the project.

c) Short term goals split the larger task into smaller sets of problems solving exercises. At each stage a problem is identified and the mind begins working on it, usually on various cognitive levels.

d) Awareness of the task is given priority in terms of mind space and actions.

e) Short term goals help build task experience. Task experience is required for making radical leaps or creative leaps.

Consistency!

Consistency is the key. It's up to you to be consistent with your actions every week to realize your true potential. You have so much talent and purpose inside you, just waiting to be unleashed. But the world can't benefit from your gifts until you share them consistently.

As my friend Mike Litman says, "You're either consistent or you're non-existent!"

That's so true, especially in the world of business. Over time, the consistent doers always win out over those who have a "stop and go" approach to their work.

Mike Litman is the bestselling author of Conversations With Millionaires, and he has spent a great deal of time interviewing the most successful entrepreneurs on the planet. If you've heard of Tony Robbins, Brian Tracy, or Jim Rohn, then you can appreciate the level of credibility from which Mike says the above quote.

So what can you do to be more consistent week after week? Well, here is a list of a few suggestions to get you started:

1) You want to develop the habit of writing down your daily "big rocks" on a piece of paper everyday. You can do this either first thing in the morning or as the last activity before you go to bed at night. Note: This concept was reviewed in last week's newsletter as part of Step Four. Take another look there if you want a quick refresher.

2) Commit to wisely use the "Power 15" to your advantage every morning. The "Power 15" is the first 15 minutes after you wake up in the morning. To get your day started right, you want to feed your mind with positive, uplifting material during this time. This information can be in the form of books, audios, videos, or whatever works best for you.

If your mind is telling you right now that you don't have time in your busy schedule for this, then here is a simple solution for you:

Wake up 15 minutes earlier.

Seriously, this is a very important success habit that can help you gain true consistency and unstoppable forward momentum toward your goals. This habit could just be the extra building block you need to unlock your true potential and take your business to the next level.

As an example, the other morning I watched a Les Brown video called "You Gotta Be Hungry!" while I exercised on the treadmill in my basement. And do you think that had a positive impact on my day? You bet it did!

3) Pick one thing you want to do differently this week and do it! This can be one of the first two suggestions above or it can be something completely different. Ask yourself this question:

What is the one new habit that you can start doing this week to improve your business and/or your life in general?

After you have written down a few answers to this question, pick the one thing that will most empower you and make you feel much stronger next week at this time. Then put this item in your day planner or scheduler and plan ahead to make it happen this week. Not only will this build your business momentum and your consistency, but it will also build your overall confidence and belief in yourself.

Income that PAYS Your Child Support WITHOUT Increasing Your Child Support. Into The Limelight.

Child support is defined as that part of your income you would spend on your children if they lived with you. Custodial parents do not pay child support, because it is assumed that they are spending money on the children, either directly (clothes, entertainment, etc.) and indirectly (rent, food, etc.). Non-custodial parents are ordered to pay child support -usually a fixed amount for a certain period of time, like per week or per month - to the custodial parent, who is required to spend it for the benefit of the child. This article is written to define a method by which a non-custodial parent can create income that should pay his or her child support obligation, yet not increase the child support obligation.

Two models exist for determining child support. The first, and probably the most prevalent, is the "dual income" model - the incomes of the custodial and non-custodial parents are combined, a child support amount is calculated from the combined incomes, and then each parent's portion is determined. The non-custodial parent is ordered to pay his or her portion as child support.

The second and the more straightforward and direct, is the "single income" model. The non-custodial parent is ordered to pay a fixed percentage of his income (either gross or net), regardless of the income of the custodial parent.

Child support is fixed in a court order, usually after a hearing that determines the income and the portion that will be child support. Incidental increases or decreases in income, like cost of living raises or a random bonus, should not and usually do not change the child support amount. Most states require a certain period of time (2 years,

for example) before an increase or decrease in child support can be sought, unless the change in the child support would be a certain amount - 20% up or down, for example.

A second income stream that does not cause an increase in child support, or only a slight increase, can be used to pay your child support, without affecting your main source of income. For example, using the "single income" model and 20% for the child support multiplier, if your income (for child support purposes) is $2000, your child support is $400. Say that you create a second income of $500. Your total income is $2500, which means your child support would be $500. However, this is exactly the amount of your increase, so you can put your ENTIRE original income in your pocket AND STILL pay $100 more in child support! Oh - the second income doesn't come in to play until the Court considers it and orders it. Since web-based incomes are NOT guaranteed to

be steady, there's a chance your support won't go up - in which case, your web-income could cover ALL your child support AND put money in your pocket!

You can get this second income in several ways. Taking a second job is one way, but that may take time away from your kids and your family. Ebay is another, but that may not be steady enough to support the increase every month.

Another way is to set up a website that brings in a small but steady income each month. There are many methods to do this.

One example is SFI. There are many such websites available; however, be aware that investing money into a web-based business may not be deductible for child supprt purposes. Write from the heart or the head or the gut, depending upon the type of writing you are doing. You can let your heart pour passion into a love letter but your head is better for the contents of a business letter and the gut feeling should never be ignored. Never try to imitate somebody else's style, no matter how much you might admire it, you will always appear fake. Find your own unique style, your own voice.

Know Your Subject

Write on topics you know about. Although that sounds obvious you don't have to look very far to find masses of people publishing articles when it is clear that they have very little idea about their subject matter. This type of writing appears thin, limp and unconvincing even to the untrained eye. You should aim for writing which has substance; a rounded, healthy thing with a life of its own. If, for some reason, you are obliged to write about a topic which is alien to you, make the effort to research it. If you can't get to the library, there is always the internet. There is no excuse for ignorance. There is no excuse for trying to foist a poorly researched article on your readers. Do you want your readers to point you out as someone who does not know what s/he is talking about?

Be interested

Write about things which interest you. If you are not interested in your subject matter, you have little hope of catching the interest of your reader. If you are in a situation where you simply have to write about a subject which holds no real interest for you, try at least to find an original angle; this could stimulate you as well as your reader. If you cannot spark even faint interest in your subject, your writing will be flat and boring.

Punctuate proudly

Don't be one of those people who pretend they don't think punctuation matters: it does. Ask your self this: if these people really believe that, why do they bother to punctuate at all? Why don't they just write on and on without any dots or commas? That, surely, is more logical than putting in dots and commas in the wrong places. The truth is, they are too lazy to learn the rules of punctuation and think they can get away with this by brushing punctuation off as unimportant. Punctuation has had a very bad time over the last forty years or so but I believe it is about to undergo a revival. These things go in cycles and it seems that punctuation is about to have its day at last. Correct punctuation could be the new black. If you don't believe this, how do you explain why so many thousands of people bought "Eats, Shoots & Leaves"? Even if you have no interest in creating elegant prose, you should learn about punctuation . Without it your writing will at best be difficult to read and at worst not make sense. You will be left wondering why people are laughing at your serious work.

Respect the apostrophe

I know, I know, this is part of punctuation. I happen to think that apostrophes have spent so long being either ignored or abused they now deserve a mention of their own. I can cope quite well with commas and full stops appearing in the wrong place but an incorrectly inserted apostrophe makes me see red. Why do so many people insist on using the apostrophe when they clearly have no idea of its function? Beats me. An improperly placed apostrophe is to writing what a huge, ugly wart is to the nose on a beautiful face. Cruel people will point and laugh at you. You think I am exaggerating? If I am part of a minority on this point, why did so many people buy "Eats, Shoots & Leaves" that it became Book of the Year? Perhaps they thought it was a story about a panda.

The rules of grammar are not difficult. In the olden days even little kids were taught grammar at school. Like mathematical tables, grammar is no longer treated as an important subject. Most people can get through life without missing the tables which were once memorised by every child who ever went to school. People now have electronic calculators to do their mathematical thinking for them but nothing has replaced the need to understand basic grammar. Please don't make the mistake of relying on the "grammar check" on your word processor: I am not saying that this tool is entirely without merit but, if you do not know the rules yourself, you can create hilarious results by going along with the recommendations of your word processing package. Another good thing about the rules of grammar is that they don't keep changing so, once you learn the rules, they will stand you in good stead for the whole of your writing career. Along with punctuation, it is grammar which determines whether or not your writing makes sense. If you don't know the rules, you will not know if your writing makes sense but other people will, believe me. (Back to pointing and laughing again.)

Do you feel the world has already reached the point of being at a stand still and that it is just sitting waiting to blow any minute? This world cannot take any more of the effect of man's energy when all it focuses on is power, money, greed and more power. Don't you agree?

Just the other day, I was sitting in the park next to my apartment watching children playing with their mothers all around them. I thought to myself for a moment. Nowadays, the way we do things should be done all in reverse! It should be the men who stay at home watching and playing with the children while their wives go out to work for the day, trying to find new ways of fixing the big mess we are facing in this world! That seems to be the only feasible way now!

Men have been dominating the world for too long. The past 1000 years have been governed by the "1" vibration.

The energy of the "2" will remain with us between the years 2000 and 2999. This is all very well; however, nothing seems to have improved at all! I kept on contemplating and I realize that there is one thing that is wrong with so many women. I will get to that point later on!

Since 1950 the women's movement began getting stronger in western society. Although noted, the movement started earlier than the time I have written, but for arguments sake, we will focus on the last 50 years before year 2000 begun with the shift of the universal energy.

During this period women's rights started to increase further into becoming equal rights. Even so, there are still many issues that are yet to be tackled which the society of men are resisting letting go of.

To understand what I am trying to say in this article, we need to understand first that there are two main vibrations that we work in this world. Those are the male and female vibrations. Let's consider that the Male vibration was in domination for the majority of the last past 1000 years. During the 19th century alone of male domination, what in the world did we really accomplish other than World Wars I & II, the Vietnam War, the Israel / Arab war, the Korean War, the Gulf war and many other wars which have taken place in many other parts of the world? All these wars have been fuelled by mans greed and hunger for power and if we took some time to read up on the history of any of them, we could be honest and say that in reality we accomplished very few things as a result.

So far we have managed to get to the moon and we are now able to at least explore some of our universe. This is all very well, but somehow it seems to be all for the wrong reasons. With all of this comes the issue of who is going to be in control of that space we have discovered. Whoever manages to gain that control, for sure they will think it will bring them again, even more power. It seems that what we have accomplished throughout the 19th Century has only brought more grief, hate, anger, frustration, disliking each other according to our religions, our culture and our color, and many other judgments to exist between us. So when we live in a world based on all of these negative feelings, what kind of an accomplishment is that after all?

We are able to see everywhere around us today in all the terrorism, the war on drugs and the drive on weapons of mass destruction. These are but a few examples. Another thing is that something I feel deep inside reflects my personal opinion on the issue of diseases such as AIDS and SARS. I believe that many of the diseases, which have occurred over the last century, are man made. I also believe that they are secret laboratory projects that have been designed as another attempt of certain people gaining power over others. We are all aware that disease is a more effective and discreet means of attack than a missile or a bomb these days. It can hit masses of people, though without affecting the structure of buildings, cities, countries etc. Unfortunately, the reality is that when greed is blinding us, we will go to any extreme to acquire power in this world.

Female Vibration as our second vibration is a softer vibration, kind, human, caring,

nurturing, and intuitive was dormant during the last 1000 years, being obedient to the dominant male vibration and becoming almost non-existent as a result. During that period women were abused, treated as absent in matter of opinion and many time choice. That was really unfortunate. In the eyes of man women were toys to what men wanted or what the men wanted to see their women to be. The fashion was driven by men, Cosmetic, perfume and much other industry that dictate women's choice by being slim or being fat and tapping on their insecurity and in some non-existent self-confidence. That damage that fetch to women brought them a low self-esteem and low self-confidence. While women are seeing and watching man and the universe vibration was starting to prepare to make its shift into the 20th century. That helped in the confidence of women to start to stand up and demand change but one thing is still wrong here.

Woman have adapted to building up a great deal of male energy in their vibration. This is often an unconscious attempt of surviving in this predominantly male world. It is as if they need that male energy in order to gain their own position in society. This is one main reason why women are still not succeeding in the way they should be as females. Here is an example, there are two candidates running for the position of manager in the same office. One candidate is a woman and the other is a man. The man is as masculine as we know a man to be and the woman is a woman inside a woman body, however, she is overloaded with male energy. So who would you choose? What is the best option for the woman? Is it to attempt playing the role of a man in the hope that you have a better chance of being hired? Many women think that being a woman is a weakness. They think that women are too soft and delicate and that they are sissies! Men are always the ones in power, so who can blame them? Women think it is cool to act like men, to be tough, to be a fighter and a survivor. Most of the world thinks that way, so who do you think gets the job? Of course, the woman loses. Yet, maybe if she had just been herself, an admirable, smart, intelligent and powerful woman then perhaps she would have had a better chance at getting the job? Who knows?

I want to see woman in a higher ranking. I want to see women leading our countries. This world is sick. This planet is sick and needs the caring love and compassion from a motherly energy to heal and take care of it. All you women out there do not be afraid! You will lose nothing by being who you really are! Honestly! Just bring forth your real female energy and the universe will support you regardless. You came to this plane as a woman for a reason, not to try and become a man, something of which you are not! Now in our time woman should have the upper hand for the next 1000 years whilst the universe is sending us a predominant female energy. You are being asked to balance your male and female vibration and that means by NOT allowing your male vibration to take over your own essence of being a female with that energy and personality. Don't walk like man, there is not need! Don't act like a man and don't try to be like a man, for you are not one! Allow your femininity to resurface. Don't lose your male side just balance it by not allowing it to take over your female side completely because it really doesn't mean that you will have better shot at rising to the top more easily.

These days many of our relationships are not working, and on many occasions it is because both people involved are acting as if they are the male in the relationship. It makes me wonder why people even bother to judge people who are gay or lesbian because energetically, heterosexual relationships are the same thing when they consist of a couple of different sexes, yet with same vibration. Pay attention to women who are walking on the street and you will see for yourself. Watch the way they walk and watch their attitude. Just because they have breasts, wear make-up and dress in a skirt and heels, it does not make them a woman if their energy is not feminine. Does it make any sense to you? You will be amazed at how many women you see who are like men; now that it has been brought to your attention!

I really urge woman to wake up! In reality women are the stronger sex and we can see they are already beginning to hold major positions these days. There are many women these days who do hold high positions, yet how many of them are working from a true female vibration with their male energy balanced? Challenge men on the right issues. Challenge them on things where they are bought by big corporations. Challenge them to handle the problems with the environment, challenge them with Medicare, challenge them to handle the issues with the homeless people sleeping on the streets and challenge them to deal with child care. Challenge them with issues that require the application of love, compassion, sensitivity, patience and acceptance. We need to learn how to begin bringing value to all human beings and treat all individuals as a soul, because that is what we all are instead of being just another number in the system. Challenge men to fix the problems with wars that are driven with the intention of claiming control over our planets oil. The wars that are created with a fake intention of taking care of normal people whilst other men, women and children in our cities are homeless, poor and starving. Our intentions are all wrong and our interests are based upon satisfying very few of the population whilst others remain feeling abandoned and hopeless.

Women need to state their true intentions and BALANCE their male and female energies because all the limitation which exists in women's lives is there because they accept it. Before assuming that the window regulator must be replaced you should first rule out the possibility of dirty electrical contacts. On most cars the main power for all switches goes through the master switch located at the driver's console. Sometimes the switch is dirty causing the window to malfunction. Should you determine that the contacts are clean and your switch is functioning, then it is likely that the motor has burned out and is in need of replacing. Musicians love to play there and once you see it, you'll know why. There are also a group of mountain parks owned by the City of Denver. Some of the most popular of these include Cub Creek and Dillon Park, Daniels Park, Echo Lake Park, and Lookout Mountain Park. Use of all these parks is free and they are great places to hike around and see some beautiful mountain scenery. These parks are all west of Denver and are easy to find. Don't miss Genesee Park. It's only about 30 minutes west of Denver and is home to an honest-to-goodness buffalo herd.

Fishing and other forms of water sports can be found at our two metropolitan lakes - Cherry Creek and Chatfield Reservoirs. Cherry Creek Reservoir is about 25 minutes southeast of downtown Denver via Parker Road. Chatfield can be reached by driving south to C-470 and then west to Wadsworth Blvd.

Finally, try to drive up to Evergreen, CO via I-70 or Colorado #73. If you take Colorado #73, you'll go through a couple of fun, small towns - Morrison and Kittridge -- and drive a beautiful canyon. Evergreen itself hosts many small shops, excellent restaurants and even a Denver Public Golf Course where you get to drive over one of the largest boulders you'll ever see.

Our small company, which had previously done business only in the U.S.A., was recently purchased by a large organization with business units located around the world. The plans were laid for our integration into the new parent company, and our work methods and procedures changed substantially.

My coworkers and I found developing close working relationships with employees located in other countries and from different cultures to be a particularly challenging part of the transition. We were accustomed to most of our fellow employees residing in the same building, and now we were part of a team that stretched halfway around the world. Sometimes it was hard to understand that we were all part of the same workforce. We worked and learned about cultural diversity together, and have built strong partnerships over the past year. Modern technology links us all everyday - by phone, e-mail teleconferencing and for some, frequent international travel. Much of our learning was accomplished through trial and error, and we all made some mistakes that we laugh about and some that we are quite content to forget. Here are a few of the lessons we learned, offered in the hope that they may be helpful to others:

* Go slow- listen a lot, and get to know your new coworkers. Remember that it takes time to build strong business relationships - in any culture.

* Learn the culture - do a little research - it's easy to find out about customs involving titles, surnames, or status, and can save you the embarrassment of unnecessary social mistakes.

* Be sensitive - find out what cultural rules apply and be considerate enough to abide by them. Be careful in conversation, and avoid non-business topics like politics, religion and humor, at least until you become better acquainted.

* Recognize differences - in attitudes and practices across cultures, especially when dealing with work issues like punctuality, scheduling, and deadline flexibility.

If your business is going global on a large scale, your company might consider offering its employees a training program in workplace diversity or multicultural relations. Take advantage of these opportunities when offered, or suggest them to the appropriate people in your organization. Employee satisfaction surveys have shown that being well informed helps when deriving the maximum benefits in productivity and performance for the entire organization.

Here in Kansas, where we live, the leaves are turning beautiful shades and falling off the trees. Just last week, I was babysitting some little boys and we were playing outside. The area around their home was carpeted in leaves--ready for our enjoyment! We raked the leaves into huge piles, jumped in them, buried people underneath them, and threw leaves at each other. We had a blast! There was almost constant giggling, and no one was ready to go in when it was lunch time. (Except for the babysitter who had had enough leaves in her hair for one day!). Though such a simple thing, our time playing in the leaves brought such wholesome enjoyment. It also served to remind me of days gone by when I was a little girl. Every fall, my parents took us outside and played in the leaves with us. What happy memories!

While being chased by little boys with handfuls of leaves, I couldn't help but wonder how many other children were missing out on such pleasure.

Instead of sending me off to daycare, Mom read to us, sang with us, taught us finger plays, and took us to museums. Instead of fast food for dinner, we had home-cooked meals with homemade bread we'd helped knead or green beans we had picked from our garden. Looking back over my childhood, I won't tell you my parents were perfect, but I do know they always had time for us. They realized that more important than our involvement in sports, or their volunteering in the community, was that they took the time to teach, train, and enjoy their children.

Last week, a 19-year-old friend of mine died suddenly in a tragic car accident. Neither she nor her parents knew that Wednesday was her last day on this earth. Although we are grateful Rebekah is now in the presence of the Lord, we grieve that we no longer have an opportunity to spend time with her on this earth, and we are all reminded that our life is just a "vapor." While you still have it, take the time to invest in the lives of your children and those around you. Cherish each moment. You may not have many left.

You may be thinking, "But I just don't have the time." Make the time. Evaluate your life: What activities are you currently involved in that are not going to matter ten years from now? How about 100 years? Simplify your life. Get rid of clutter and make room for joy. Someday when your children are grown and gone, they are probably not really going to remember the presents you bought for them or the opportunities you allowed them, but they will remember the time you spent with them.

There are a lot of good things in life for one to devote time to--but only a few of those things are the best things. My parents chose the best, and I will always be indebted to them.

Don't let another priceless moment slip through your hands because you are "too busy."

Charter Remedies: 24(1) & (2). Preventing Cancer with Green Tea?.

Once a litigant has established that their Charter of Rights and Freedoms' rights have been violated what remedies are available?

Parliament has provided two sections in the Charter to address this: 24(1) to guarantee the enforcement of enumerated rights and freedoms; and 24(2) to exclude evidence that would bring the administration of justice into disrepute.

With any law the place to start is with the wording of the section.

It is "presumed that the legislature avoids superfluous or meaningless words, that it does not pointlessly repeat itself or speak in vain. Every word in a statute is presumed to make sense and to have a specific role to play in advancing the legislative purpose": of Tower v. M.N.R., [2004] 1 F.C. 183 (F.C.A.) per MALONE J.A. at 15 - 16.

Enforcement

" 24(1) Anyone whose rights or freedoms, as guaranteed by this Charter, have been infringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances."

The language of 24(1) is expansive and remedies fashioned under it cannot be distilled into a formula for general application: R. v. Mills, [1986] 1 S.C.R. 863.

If an applicant is challenging the constitutionality of the legislation itself, then recourse to s.24 is unnecessary:

R. v. Big M Drug Mart Ltd., [1985] 1 S.C.R. 295; but where the applicant seeks to enforce their Charter rights, then the courts can grant, in appropriate circumstances, offer remedies including: habeas corpus, injunctions, return of seized documents, damages, costs and in the most serious breaches a stay of the proceedings: R. v. O'Connor, [1995] 4 S.C.R. 411 at 75 - 82.

The person claiming that their Charter rights have been infringed must apply to "court of competent jurisdiction" and claim the relief they seek. Normally, the forum will be the tribunal that has jurisdiction over the person: R. v. 974649 Ontario Inc., [2001] 3 S.C.R. 575; the subject matter and have the authority to make the order sought: R. v. Mills, [1986] 1 S.C.R. 863; but it may not actually be a court, per se: Nova Scotia (Workers' Compensation Board) v. Martin, [2003] 2 S.C.R. 504.

Generally, in order to seek a remedy an individual must have "standing," which is to say, that it is their Charter rights which have been infringed: R. v. Edwards, [1996] 1 S.C.R. 128; but there are exceptions: R. v. Thompson, [1990] 2 S.C.R. 1111.

Typically the alleged infringement will have been in the past: United States of America v. Kwok, [2001] 1 S.C.R. 532; but in rare circumstances the infringement may be prospective: Phillips v. Nova Scotia (Westray Mine Inquiry), [1995] 2 S.C.R. 97.

The burden of proving - on a balance of probabilities - that the infringement of their Charter rights has occurred is with the applicant: R. v. Collins, [1987] 1 S.C.R. 265.

Once the applicant has discharged their onus and established the breach it will be for the court to produce the appropriate remedy. Courts act in a manner that is responsive to the protected right and they will fashion a remedy that is effective in remedying the Charter violation: Doucet-Boudreau v. Nova Scotia (Minister of Education), [2003] 3 S.C.R. 3.

Charter 24(1) is not used to exclude evidence because of an infringed or denied right or freedom, that is the purpose of Charter 24(2); R. v. Therens, [1985] 1 S.C.R. 613.

Exclusion Of Evidence

" 24(2) Where, in proceedings under subsection (1), a court concludes that evidence was obtained in a manner that infringed or denied any rights or freedoms guaranteed by this Charter, the evidence shall be excluded if it is established that, having regard to all the circumstances, the admission of it in the proceedings would bring the administration of justice into disrepute. "

The Supreme Court of Canada established three (3) criteria for consideration by a court, under 24(2), in deciding whether to exclude evidence: R. v. Collins, [1987] 1 S.C.R. 265.

First, will the admission of the evidence affect the fairness of the trial? If yes, then to allow the evidence to be used would tend to bring the administration of the evidence into disrepute and so it must be excluded, without considering other factors, such as whether the evidence is conscriptive or non-conscriptive: R. v. Stillman, [1997] 1 S.C.R. 607.

Second, how serious is the Charter violation? In assessing this, the court will consider factors such as bad faith, was it inadvertent or of a merely technical nature, or whether it was deliberate, willful or flagrant, was urgency a factor, whether there were alternative means of obtaining the evidence: R. v. Therens (1985), 18 C.C.C. (3d) 481 at 76 (S.C.C.); if the officer(s) failed to follow procedures: R. v. Law (2002), 160 C.C.C. (3d) 449 at 38 (S.C.C.); and R. v. Caslake, [1998] 1 S.C.R. at 34.

Third, the court must balance the interests of truth with the integrity of the judicial system: R. v. Simmons, [1988] 2 S.C.R. 495, at p. 534; or put differently, "whether the vindication of the specific Charter violation through the exclusion of evidence extracts too great a toll on the truth seeking goal of the criminal trial": R. v. Kitaitchik, (2002), 161 O.A.C. 169, per Doherty J.A. at 47, as see R. v. Buhay, [2003] 1 S.C.R. 631.

In essence, unconstitutionally obtained evidence will not often affect the fairness of the trial, but if admitting it would be to offer judicial condonation of unacceptable police or prosecutorial conduct then it will be excluded: Collins, above at 31.

In R. v. Clayton and Farmer, released March 18, 2005, as Docket №s C37990-C36722 (Ont. C.A.) per Doherty, J.A. (at 95) introduced another criteria, whether the violation was

a result of poorly trained and supervised officers, amounting to an, "institutional failure to equip officers with the training necessary to perform their duties within the strictures of the Charter."

Willful, flagrant or deliberate breaches of an accused's Charter rights, in order to obtain incriminating evidence, would usually tend to favour exclusion of the evidence: see R. v. Genest, [1989] 1 S.C.R. 59; R. v. Manninen, [1987] 1 S.C.R. 1233; and R. v. Greffe, [1990] 1 S.C.R. 755.

Conclusion

Most Charter applications are made in criminal cases; for the simple reason that although constitutional law tends to be slow, expensive, slow, complex and prone to appeals, an adverse result for an accused is even worse than the litigation.

All such cases are fact driven; the facts are not a mere technicality; rather, they are essential to a proper consideration of Charter issues: R. v. Bain, [1992] 1 S.C.R. 91 per Gonthier, J. (dissenting).

Since no Charter decisions can be made in a factual vacuum: Hy and Zel's Inc. v. Ontario (Attorney General), [1993] 3 S.C.R. 675; generalities in such matters are inherently perilous; however, by applying the principles established by case law, to any actual case, lawyers are able to assess the results - on the balance of probabilities.
